After you have been in the business another 15 plus years and have not had any suits for as long as I have not…we’ll talk. I am clearly not more likely to get sued than you…or I would have been by now.

No, but one of us is the one least likely to get our clients into serious trouble. One of us is more likely not to be sued by our clients (along with our broker) as a third party defendant. One of use is the one most likely not to be sued for consumer protection act violations that might not be covered by our firms malpractice insurance.

Losing a pending sale after 4 months is entirely different than having your property tied up in litigation for four years and being unable to sell it during that time.

(BTW, in the case I cited the buyer didn’t obtain a stay pending appeal. In Federal court the seller could still sell (at least a bankruptcy trustee could). I’m not aware of any similar rule for state court, but the court did talk about the issue of the case being moot, so maybe. But sill, if the buyer did obtain a stay, you’re clearly along for the ride for the duration of the case.)

You’re not suggesting that someone having “legal training” makes them a better agent ipso facto, are you?

Gut instinct goes a long way in this business, and those of us who are better at it have no law suits in the last 18 years. Our record says it all. That’s why we would say “yes do it” in one situation and “no, don’t do it” in another. There’s no one size fits all in real estate.
