(and I was thinking the same thing about prematurely releasing EM…especially if escrow feels pressured by an agent that sends a LOT of business to escrow) Further, escrow does not really want to hold anything…let me re-phrase….escrow does not want to get into the middle of anything. There is much too much other pressing matters to work on.
Escrow abides by the P & S agreements AND by the escrow instructions the parties have signed. Generally, if the parties can’t get something resolved within 30 days, then interpleading takes place.
“I don’t care if you have to interplead, I just don’t want the other party to get anything” – that’s the real deal folks.

November 4th, 2007 at 7:37 pmDavid, you bring up many issues. Yep, the excesses of yesteryear are coming home to roost and, for some, we don’t like the consequences. So, instead of facing the challenge head on we postpone it or do other things like devalue the dollar which has its own set of thorns. You kind of put it all in perspective, thus, one of the reasons I suggested that “the world does not revolve around real estate.” For example, (not to change the subject) Pakistan unraveling. Sadly, a friend of mine could not point out Pakistan on a map. My friend’s world is very closed. A country in political choas with nukes is not good regardless of where one is on the political spectrum.

July 5th, 2007 at 10:53 amArdell, I know of very few instances where AfBA’s have directly benefited consumers both financially and in a fiduciary capacity. Sorry this is off topic from appraisers. For example, I have countless times given disclosures to a client indicating afflilated business relationships within the loan package that the lender, title company or real estate brokerage has: stating that the borrower has the ability to shop.
What is wrong with this picture? It’s done at closing. Rediculous.
PS. What do you think the response will be if I ask agents “what is your rescission rate?” Just teasing.

Lynlee & I will do a post on your question. It deserves it. It raises tons of questions. Tons of em: ethics, agency issues, agents blind faith that the LO is acting in the best interests of their clients, agents who believe they are writing iron clad addendums regarding contributions, or ANY other P & Sale contractual item for that matter.

I appreciate your feedback, whether people agree with you or not. I think it’s great that consumers outside of the industry would chime in on this blog–hope more & more do so.
If you read this, I’d like to know what led you to the idea of not using a traditional agent to help you with your sale. Have you had poor experiences with agents before? If so, describe, if you would, the details. One of the hot topics in real estate is value received for commission paid–did I get my money’s worth. Perhaps the Realtors who frequent this blog could learn about your approach and thinking regarding this issue.
